In feb 08 i took out a 18500 401k loan out for down payment on a new home. In May 08 i was laid off from that employer. I did not do a rollover at the and my 401k balance was 43000–18k for the loan= 25k December 08, 401k balance is now 32k with the 18k loan = 14k So if i cash out the 401k provider will tax 20% of the 32k (6.5K) and subtract the 18k for the loan which will leave me with a check for 6.5 k I heard that the irs is waiving the 10% penalty if you in hardship or used it to purchase a home. yes I do need the money so I 'm thinking of cashing it b4 the 31st of Dec 08. I figure since my income was not that high this year I can recoup most of the 20% that was held for IRS.
